Mothers online TERMS AND CONDITIONS

Please read our terms and conditions with care. They form the agreement between you and Mothersonline, (Mothers Online Ltd), and should be considered carefully prior to you becoming a member. They contain all information covering your rights and obligations in using the Mothers online website (“our site”). Your use of our site and ongoing membership with us confirms your agreement to these terms and conditions and any amendments thereon which may be entered on our site from time to time. By clicking on the “I confirm” box on the Join Us Now page of our site, you are agreeing to be bound by the terms of this agreement.

1. Our Site

Our site is intended to create an online community for Mothers, providing the venue for communication, support, networking, classified advertising, exchanges, information and advice. Mothers online does not intend to operate as an alternative to consultations, treatments or diagnoses by a properly qualified practitioner. It is the responsibility of individual members to assess the information received from the site in light of their own particular circumstances.

Any incoming communication to Mothers online will be made by email to admin@mothersonline.co.nz . Any outgoing communication from Mothers online will be made by email or post to the email address or postal address provided by individual members upon registration. Communications will be deemed to have been received within 24 hours of an email being transmitted and within 3 working days of postage.

These terms and conditions may be amended from time to time without notice and the updated version will be posted on the site without delay. Upon display of the new terms and conditions on the site, all activity will be governed by the updated version.

2. Site Content

Individual members are solely responsible for the content they create, display and publish on the site in all areas including Member profiles and all communication, either directly or indirectly, with other members.

Members are not to publish or display any offensive content, nor conduct oneself in a manner that would amount to any offence, threatening behaviour, abuse, racism, obscenities, harassment or unlawful behaviour.

Members may only create one Member profile on this site. They may not masquerade as another person or entity nor access the information from another’s profile for any purpose whatsoever.

Members may not publish or advertise any false information or products on the site. Only advertising as agreed within these terms and conditions is permitted by Members without the full written consent of Mothersonline.

The written content of our site is provided solely for informational purposes. Mothers online makes no guarantees as to its applicability or otherwise regarding individual members and the responsibility of assessment lies with the member.

Mothers online does not accept any responsibility for any content published or transmitted on the site, nor make any warranties or undertakings as to its accuracy. While Mothers online will take every reasonable attempt to include reliable sources and content on the site, it will not endorse, nor be responsible for the views expressed, advice given and assertions of any Members of the site. Views, advice, assertions, proposals, recommendations or suggestions and other contributed content available on the site are made by the specific individual and should not be considered reliable without full and proper consideration or analysis.

Mothers online gives no undertakings or warranties whatsoever, whether written or implied, as to the function of the site, the information or content. No content whatsoever, including but not restricted to, medical data, contained on the site or in any communications from Mothersonline, its employees and agents shall give rise to any warranty or endorsement nor should be considered reliable without full and proper consideration or analysis.

Mothers online reserves the sole discretion to amend, edit or delete any content published or displayed that is in contradiction of these terms and conditions. Mothers online does not make any undertaking that such content will be removed despite every reasonable attempt to do so being made.

3. Site Access

Mothers online does not undertake that any of its services will continuously remain available, secure, uninterrupted and free of errors. Individuals may not try to interfere with the proper functioning of the site by virtue of tampering, hacking, or circumvention of security nor disruption to any related computer system, server, router or other internet connected device.

From time to time it may be necessary to suspend access to the site without notice, in any situation requiring maintenance or repair. Any system malfunctions or circumstances outside of the control of Mothers online may also lead to the interim unavailability of the site and its services.

4. Site Membership

Individuals may request and obtain only one free trial period on this site. After that time you will receive a first stage membership at no charge. Your continued agreement to these terms and conditions is construed by you clicking “I agree” at the time of initial sign up.

Individual members are solely responsible for securing their account and password details and ensuring no unauthorized access. Any use of those details will be deemed to be at the knowledge and full acceptance of the individual member.

Mothers online shall not publish or disclose the personal information of any member for any reason whatsoever without first receiving the written consent of that member.

Subscription cost, payment methods, terms and member services may change from time to time at the sole discretion of Mothersonline. Any such changes will be notified to affected members at the earliest opportunity.

Subscriptions may not be held or suspended at the request of individual members.

Mothers online retains the absolute power to suspend and/or terminate the membership of any individual at its sole discretion. Subscriptions will not be refunded if there has been any breach of these terms and conditions resulting in termination.

Any refunds of Membership subscriptions will be given at the sole discretion of Mothersonline.

5. Communications with Other Members

Individual members are solely responsible for their interaction and communication with other members. They agree to be solely liable for the content and manner of those interactions being lawful, in keeping with these terms and conditions and appropriate.

Mothers online does not intend to monitor all communications between members, however we retain the right, without obligation, to edit and delete any communications that are considered to be breach this agreement, contain advertising outside of these terms or be material which is classified by Mothers online as spam.

Mothers online cautions against the risk of dealing with other members who may act under false pretences or with criminal intent. Mothers online cannot monitor any meetings in person resulting from a member’s involvement on the site, however, should any member exhibit behaviours considered harmful towards other members, you are requested to supply Mothers online with details thereof.

6. Classified Advertising

Any representations or assertions made in relation to all classified advertising on the site are made by the individual member and have no connection to Mothers online except through their membership. Mothers online does not make any representations, endorsements, warranties or undertakings whatsoever in respect of any product or service advertised therein.

The cost of any price or service advertised is subject to direct communication and negotiation between the Member advertising the product or service and the member enquiring. Subsequent to the initial email contact being directed via the site, Mothers online takes no responsibility or liability in respect of any resulting transaction or agreement for services.

By advertising any product or goods for sale through the classifieds, the individual member agrees to sell those goods upon appropriate and agreed to terms. The member must be in possession of the items and capable of passing title to those goods.

By advertising any services available through the classifieds, the individual member agrees to provide those services to a competent and reasonable standard. The member must also possess the necessary skills and circumstances in which to perform those services.

To qualify as an advertiser in the Buy & Sell section of the site, the member must be an individual, (not a company or commercial enterprise) and not be in the business of selling products of a commercial nature. The listing of any other products or services in this area of the site will immediately incur an annual service fee of $100 + gst per annum. Invoices will be sent directly to the advertiser for payment.

To qualify as an advertiser in the Services Available section of the site, the member must be a mother working solely from home, without employees and not be in the business of selling products of a commercial nature. Any other advertising enquiries should be directed to Mothers online by way of email communication to advertisers@mothersonline.co.nz.

Mothers online reserves the right to inquire into and if necessary, edit or remove any advertisements in the Buy & Sell or Services Available section of the site that do not comply with these terms and conditions and to notify the member of the reasons for this without delay.

Advertisements placed in the Situations Vacant area of the site are placed in good faith at the request of the advertiser. Any further communication and action is at the sole responsibility of the individual member. Mothers online has no responsibility in respect of employment decisions made or outcomes to either the advertiser or the individual member.

Mothers online cautions against the risk of dealing with other members or advertisers who may act under false pretences or with criminal intent. Mothers online cannot control the outcome of any transactions resulting from the classified section of the site, however, should any member exhibit behaviours considered harmful towards other members, you are requested to supply Mothers online with details thereof.

7. Site Links

Mothers online may provide links to other websites which are operated by other entities and provide related products and/or services. Mothers online gives no undertakings, assertions or endorsements in respect of those sites or their products, services, costing, terms of trade, quality or reliability.
Mothers online is not responsible for the content or use of such sites, and shall not be held liable for any loss, damage or suffering that is a result of or an alleged result of any interaction with those sites. Any difficulties encountered by members with any such sites should be resolved with the particular site administration.

8. Ownership and Copyright

Mothers online is the proprietor and holder of property rights in respect of all content as it is compiled on the site, such content being protected by New Zealand and international copyright laws. All product and company names, along with logos and other materials may be the trademarks, intellectual property or trading names of their individual owners or suppliers.

All information and materials contributed by other individuals or entities, may remain their own property except to the extent of any agreement between themselves and Mothersonline. Any unauthorised reproduction or publication of such material will result in further infringement of property rights.

Users of the site may not distribute, republish, display, modify, reproduce, copy, post or otherwise replicate any information or materials appearing on the site without the written consent of Mothers online and where necessary the owner of the material. Any requests for such use of information or materials should be made by email to admin@mothersonline.co.nz.

You are permitted to create a link to this site by use of the Link with Us page situated on the site. Any such link is not permitted to represent or infer any endorsement or support by Mothers online for any individual, company or entity.

The use of any other content or materials whatsoever displayed on the site, whether originating from Mothers online or third party sources may not be used for any commercial purposes without the prior written consent of Mothersonline.

9. Limitation of Liability

Users of the site agree to indemnify Mothers online and Mothers Online Ltd, all officers, employees, agents, affiliates and related parties from any losses, damages, claims or expenses (including, but not limited to direct, indirect, special, consequential, incidental, punitive, exemplary or other damages of any type, or any loss of income, profits, goodwill, revenue, data, loss of business or loss of contracts) resulting or allegedly resulting from your use of or involvement with the Mothers online website.

To the fullest extent permitted by law, Mothers online will not be liable to users for any such loss whether due to inaccuracy, error, omission, or any other cause. This applies to any violation of this agreement or the publication by any member on the site of content that may infringe the intellectual property rights of any third party, or denigrate, defame or invade the privacy of any third party. Where any such liability is alleged it shall, in any event, be limited to the sum of any payment made between the parties, namely, any subscription amount paid by the individual member to Mothersonline.

10. Governing Laws

Mothers online and Mothers Online Ltd, along with these terms and conditions will be governed by and interpreted in accordance with the laws of New Zealand. All users of the site accept the jurisdiction of the Courts and Tribunals of the governing law.
